These Terms of Service ("Terms") govern your use of the PetaHash Miner website (petahashminer.com), services, and products. By accessing our website, placing an order, or using our services, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using PetaHash Miner's website, products, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.
2. Changes to Terms
PetaHash Miner reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after any changes indicates your acceptance of the modified Terms. We will make reasonable efforts to notify customers of significant changes through email or website notifications.
3. Product Information
3.1 Accuracy of Information
While we strive to provide accurate and up-to-date information about our products, including specifications, performance metrics, and pricing, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free.
3.2 Product Availability
All products are subject to availability. We reserve the right to discontinue any product at any time. If a product is unavailable after you place an order, we will notify you and provide options for alternative products or refunds.
3.3 Product Specifications
Mining hardware specifications, including hashrate and power efficiency, represent expected performance under optimal conditions. Actual performance may vary based on operating environment, power quality, firmware version, and other factors. Performance variations within 5% of stated specifications are considered normal and do not constitute grounds for returns or warranty claims.
4. Ordering and Payment
4.1 Order Acceptance
Your order constitutes an offer to purchase our products. All orders are subject to acceptance by PetaHash Miner. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or concerns about fraudulent activity.
4.2 Payment Methods
We accept various payment methods, including credit cards, wire transfers, and select cryptocurrencies. By providing payment information, you represent and warrant that you have the legal right to use the payment method and that the information you provide is accurate.
4.3 Pricing and Price Changes
All prices are listed in US Dollars unless otherwise specified. Prices are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed. Price changes will not affect orders that have already been accepted.
4.4 Taxes and Duties
Prices displayed do not include taxes, import duties, or customs fees unless explicitly stated. You are responsible for all applicable taxes, duties, and fees associated with your purchase. For international orders, we are not responsible for any customs delays, additional charges, or restrictions imposed by your country's customs authorities.
4.5 Order Cancellation
Orders for in-stock items may be canceled within 24 hours of placement without penalty. Orders for pre-order or back-ordered items may be canceled at any time before shipment without penalty. Once an order has shipped, our return policy applies.
5. Shipping and Delivery
5.1 Shipping Methods
We offer various shipping methods as described on our Shipping Information page. Delivery timeframes are estimates and not guarantees. We are not responsible for delays caused by shipping carriers, customs processing, or other circumstances beyond our control.
5.2 Risk of Loss
Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. For international shipments, risk of loss and title pass to you when the items clear customs in the destination country.
5.3 Inspection Upon Receipt
You are responsible for inspecting products upon receipt. Any visible damage should be noted with the delivery carrier at the time of delivery and reported to PetaHash Miner within 48 hours.
6. Returns and Refunds
6.1 Return Policy
New, unopened products may be returned within 30 days of delivery for a full refund, less original shipping costs. Opened products may not be returned unless damaged; eligible returns are subject to a restocking fee of up to 100%. Custom configurations, bulk orders, and products marked as final sale are not eligible for return unless defective.
Upon activation of the hosting environment, the associated order shall be deemed non-refundable. Cancellation or termination after activation shall not entitle the customer to a refund of any portion of the fees paid.
6.2 Defective Products
Products that are defective upon receipt may be returned within the warranty period for repair, replacement, or refund at our discretion. Please contact our support team to initiate the warranty claim process.
6.3 Return Process
All returns require a Return Merchandise Authorization (RMA) number. To obtain an RMA number, contact our support team. Returns shipped without an RMA number may be refused or subject to processing delays.
6.4 Refund Processing
Refunds will be issued to the original payment method. Processing times vary based on payment method:
- Credit card refunds: 5-10 business days
- Wire transfer refunds: 7-14 business days
- Cryptocurrency refunds: 3-5 business days
6.5 In-House Hosting
In-house hosting orders are processed within 24 to 36 hours of confirmation. The assigned mining machine becomes operational within 36 hours to several days, depending on provisioning conditions.
Once the hosting service has been provisioned and rendered operational, the corresponding order is irrevocable and non-refundable in full. No refund, credit, or other form of compensation shall be issued for cancellation, termination, or any other reason subsequent to activation.
Service Modification & Termination:
The provider reserves the right to suspend, modify, or terminate any in-house hosting account at its sole discretion, with or without prior notice. The provider shall not be liable for any loss, damage, or inconvenience arising from such action.
Limitation of Liability: To the maximum extent permitted by applicable law, the provider shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the hosting service, its interruption, or its termination.
7. Warranty
7.1 Standard Warranty
New mining hardware includes a limited warranty as specified on the product page, typically 180 days from the date of delivery. The warranty covers manufacturing defects and hardware failures under normal use.
7.2 Warranty Exclusions
The warranty does not cover:
- Damage from improper installation or use
- Damage from inadequate cooling or power supply
- Damage from modifications or unauthorized repairs
- Normal wear and tear
- Performance degradation due to network difficulty increases
- Damage from power surges or environmental factors
- Products with removed or altered serial numbers
7.3 Extended Warranty
Extended warranty options may be available for purchase at the time of order. Terms of extended warranties are provided separately.
7.4 Warranty Claims
To make a warranty claim, contact our support team with your order number, product details, and a description of the issue. Our technical team will work with you to diagnose the problem and determine the appropriate resolution.
8. Limitation of Liability
8.1 Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, PETAHASH MINER PROVIDES PRODUCTS AND SERVICES "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
8.2 Limitation of Damages
IN NO EVENT SHALL PETAHASH MINER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE USE OR INABILITY TO USE THE PRODUCTS OR SERVICES, EVEN IF PETAHASH MINER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8.3 Cap on Liability
PETAHASH MINER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS OR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
8.4 Mining Profitability
We do not guarantee mining profitability or returns on investment. Cryptocurrency mining is subject to numerous variables beyond our control, including but not limited to network difficulty, cryptocurrency prices, electricity costs, and regulatory changes. Any profitability calculations or estimates provided are for informational purposes only and should not be considered as financial advice or guarantees of future performance.
9. Intellectual Property
9.1 Ownership
All content on the PetaHash Miner website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of PetaHash Miner or its content suppliers and is protected by international copyright laws.
9.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. This license does not include the right to:
- Modify or copy materials
- Use materials for any commercial purpose
- Attempt to decompile or reverse engineer any software contained on the website
- Remove any copyright or other proprietary notations
- Transfer materials to another person or "mirror" materials on any other server
9.3 Trademarks
PetaHash Miner and related logos, product and service names are trademarks of PetaHash Miner or its affiliates. Nothing in these Terms grants you the right to use any PetaHash Miner trademarks.
10. User Conduct
10.1 Prohibited Activities
You agree not to:
- Use our website in any way that violates applicable laws or regulations
- Engage in any activity that interferes with or disrupts the website or servers
- Attempt to gain unauthorized access to any portion of the website or any systems or networks connected to the website
- Use any robot, spider, or other automatic device to monitor or copy web pages or content
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
10.2 Account Security
If you create an account, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account.
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of China (Taiwan), without giving effect to any principles of conflicts of law.
11.2 Arbitration and Jurisdiction
In the event of any dispute, controversy, or claim arising from or relating to these Terms or your use of our products or services (including the validity, breach, or termination thereof), the parties shall first seek to resolve the matter amicably through negotiations. If the dispute cannot be resolved through negotiations within sixty (60) days, either party may submit the dispute to binding arbitration.
The arbitration shall be conducted in Taipei, Taiwan, in accordance with the Arbitration Rules of the Chinese Arbitration Association (CAA). The arbitration shall be conducted by a single arbitrator, and the language of the arbitration shall be Mandarin Chinese. The arbitral award shall be final and binding upon both parties, and judgment on the arbitration award may be entered in any court having jurisdiction.
Notwithstanding the foregoing, PetaHash Miner reserves the right to apply for injunctive or other equitable relief in the courts of the Republic of China (Taiwan) or the People's Republic of China (in the jurisdiction where our office is located) to protect its intellectual property rights or confidential information.
11.3 Waiver of Class Actions
You agree to resolve any disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
11.4 Limitation Period
Any claim or cause of action arising out of these Terms must be filed within 90 days after the cause of action arose or be forever barred.
12. Force Majeure
PetaHash Miner shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, terrorism, war, civil unrest, labor disputes, or governmental actions.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by PetaHash Miner, constitute the entire agreement between you and PetaHash Miner concerning your use of our website, products, and services.
